Terms and conditions of sale
Please read these terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Ogilvy Spirits makes its products available to you. By using the website to browse or purchase goods from Ogilvy Spirits, you fully accept the Trading Terms & Conditions, and all disclaimers outlined in this document. If you do not accept these terms, you must immediately stop using the website and must discontinue from purchasing through the website.
Use of the online shop
Our online shop is only intended for use by people resident in the United Kingdom. We do not accept orders from individuals outside the UK. Please be advised that whilst we ship to most locations within the UK we do not offer this service for Jersey or Guernsey. All orders for goods placed by you via the online order form shall be deemed to be an offer by you, the buyer, to purchase goods pursuant to these terms and conditions. You, the buyer, shall be responsible for ensuring the accuracy of the details provided in your order and we will not be obliged to accept an order unless all details requested have been provided correctly.
You must be aged at least 18 years to purchase from Ogilvy Spirits Ltd online shop. It is illegal in the UK for any person under the age of 18 to buy or attempt to buy alcohol for themselves or for any other person under the age of 18. If the purchase is a gift you are responsible for ensuring that the recipient of the product is at least 18 years old.
All prices are in GBP (British Pound). The prices payable for the products that you order are clearly set out in the website. If in error we have under-priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you prior to the item. All pricing is inclusive of VAT at the prevailing rate. The total confirmed cost includes all applicable UK taxes. Delivery is not included and will be confirmed at the time your order is accepted. Ogilvy Spirits reserves the right to alter the prices of goods on offer online at any time without prior notice.
Availability and acceptance
All products offered are subject to availability, and we cannot guarantee availability of the products listed. If we are unable to fulfill your order, we will advise you as soon as practically possible (usually within 5 working days of receiving your order). There will be no contract of any kind between you and us unless we have actually processed and dispatched goods to you. We reserve the right to decline the supply of goods at any point up until then without giving any reasons. At the moment that goods are processed and dispatched, and not before, a contract will be made between you and us.
We must receive payment of the whole of the price for the goods that you order before your order can be accepted.
We use Shopify Payments to process payments in our online store. You can read more about how Shopify Payments uses your Personal Information at pay.shopify.com/tos-privacy-policy.
Unfortunately, we cannot ship our products outside of the UK at present. We do not ship to the Channel Islands. Our normal methods of delivery are by post or courier.
We can deliver to your home or work address, as you have entered it on your order. Delivery to work address will be deemed successful if a representative (e.g receptionist) at that address accepts the order and signs for the goods.
We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by Ogilvy Spirits and transfer of responsibility in the same way.
Please ensure you check the condition of your parcel before you sign for it. If it is damaged in any way, don’t sign for it, but hand it back to the courier to return to us. If you only discover that your parcel is damaged after you’ve signed for it, please call 01307 840 444 or email email@example.com.
We cannot accept any liability for late or failed delivery for any incorrect or incomplete delivery information provided. Please double check your delivery address if you are unsure.
Orders will normally be delivered within 7 days of receipt of order. If goods fail to arrive after 14 days from date of order, please contact us on 01307 840 444 or email firstname.lastname@example.org. We endeavour to secure your delivery within 7 days of the date of order but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.
In the event that the order is returned to us by the courier or otherwise due to non-delivery, we give the purchaser the option of resending at the purchaser’s expense or refunding the purchase less the cost of postage and packaging. Please note that we cannot delivery to PO boxes as a signature is required.
Returns and refunds
We hope that you will be happy with your purchase. Unfortunately, as perishable goods and some flammable liquids, we cannot offer refunds on our products, unless due to defect or deemed faulty. We reserve the right not to refund items that are returned in unusable or unsellable condition.
If you have an issue with product quality, please contact us on email@example.com. We must be notified of any damaged goods within 2 days of delivery. We will endeavour to replace/ exchange the faulty goods as soon as possible or refund the price of a defective product in full including any applicable delivery charges.
Refunds will only be given is prior communication is made with Ogilvy Spirits and agreement is made for a refund to be issued. Proof or purchase will be required prior to any refund being approved. We will refund the cost of the defective product to the original credit/debit card or Paypal account. Ogilvy Spirits will refund the purchase within 30 days of you notifying us about the return. The cost of returning the product is the responsibility of the purchaser. Liability for loss or damage during transit is also the responsibility of the purchaser.
Third party sites
Ogilvy Spirits have no control of and accept no responsibility for and do not endorse any content found within third party sites which may be linked to our site.
We aim to keep accurate images of our products on our online shop that are representative of the products that are for sale. Images are purely for illustrative purposes and packaging or product may differ slightly from the image shown. The colour of goods shown may vary from that shown on the website due to variances in web browser software, and monitor/ screen quality. Ogilvy Spirits do not accept any liability for errors or omissions of this information and reserves the right to amend designs or images without prior notice.
The copyright and the intellectual property rights of this website are owned by Ogilvy Spirits. This includes but does not limits this to the Website design, text, graphics and all software and source codes connected with the website. You can use this website for your own personal use but cannot republish or use content from this site without prior consent from Ogilvy Spirits.
